Acceptance of Terms

By accessing our website or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Return & Refund Policy. If you do not agree, please do not use our services.

Eligibility

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to place an order or create an account on our website. By using our services, you represent and warrant that you meet this requirement.

Products & Pricing

All photographs displayed on our website are available as museum-quality fine art prints in various sizes and media. Prices are listed in US dollars and are subject to change without notice. We reserve the right to modify or discontinue any product at any time. Limited edition prints are numbered, and availability is not guaranteed.

In the event of a pricing error, we reserve the right to cancel the order and issue a full refund. We will notify you promptly if this occurs.

Color Accuracy

We strive to represent the colors and details of our photographs as accurately as possible on our website. However, the appearance of images on your screen depends on your monitor's calibration, display settings, ambient lighting, and screen technology. The physical print — produced with museum-grade archival inks on professional media — is the definitive representation of the artwork. Minor variations between your screen and the delivered print are inherent to digital-to-print reproduction and are not considered a defect.

Orders & Cancellations

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline your order for any reason, including product availability, pricing errors, or suspected fraud. Payment is collected at the time of order. All prints are custom-made to order by our professional print lab.

You may cancel your order within 24 hours of purchase for a full refund, provided production has not yet begun. Once a print enters production, cancellations are no longer possible. For full details, see our Return & Refund Policy.

Shipping & Delivery

We currently ship within the United States. A flat shipping fee of $15 is applied to all orders; orders over $500 qualify for free standard shipping. Every shipment is fully insured for the purchase value of your print at no additional cost. Orders valued at $500 or above require a signature upon delivery. Estimated delivery times are provided at checkout and vary by location. We are not responsible for delays caused by the shipping carrier, weather, customs, or other circumstances beyond our control.

Sales Tax

Applicable sales tax is calculated based on the shipping destination and is displayed during checkout. Tax rates are estimated averages by state and may vary slightly from the exact amount charged by your local jurisdiction. You are responsible for any additional local taxes that may apply.

Payment Processing

All payments are processed securely by Stripe, Inc. We accept major credit cards, debit cards, and Apple Pay. We do not store your payment card details on our servers. By completing a purchase, you agree to Stripe's terms of service.

Account & Customer Portal

You may access your order history and account information through our customer portal by verifying your email address and an order number. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us immediately if you suspect unauthorized access.

Intellectual Property

All photographs, images, text, and other content on this website are the copyrighted property of Taberner Studio Photography and are protected under United States and international copyright law. Purchasing a print grants you the right to display the physical print for personal, non-commercial use only. You may not:

• Reproduce, scan, or digitize the print for redistribution
• Create derivative works based on our photographs
• Publicly display our photographs in a commercial setting without written permission
• Use our website content, including photographs and text, for any commercial purpose

Limitation of Liability

To the fullest extent permitted by law, Taberner Studio Photography shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or purchase of our products. Our total liability shall not exceed the amount you paid for the specific product giving rise to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Taberner Studio Photography and its owners, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorney's fees) arising from your use of our website, violation of these Terms, or infringement of any third-party rights.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or your use of our services shall first be addressed through good-faith negotiation. If a resolution cannot be reached within 30 days, disputes shall be resolved through binding arbitration in the State of Washington, in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated revision date. For material changes, we will make reasonable efforts to notify you via email or a prominent notice on our website.
